Sepura said last month that the department was considering a review of the acquisition, and now the Department for Business, Energy & Industrial Strategy will conduct the review by way of a public interest intervention notice under section 42 of the Enterprise Act 2002. As a result, the department requested the U.K. Competition and Markets Authority (CMA) to consider whether a public interest consideration is relevant to the acquisition as a result of Sepura's commercial arrangements with U.K. government entities.
An early deadline of midnight 4 May has been set for completion of the CMA review. Following the review, the secretary of state will determine whether to refer the matter, pursuant to s45 Enterprise Act 2002, for further review by the CMA.
“Sepura and Hytera will continue to provide full assistance to the department and the CMA during the CMA review …” said a Sepura statement.
